Crime victims; immigration status. Provides that no law-enforcement officer or other agent of state or local government shall, when investigating a crime, inquire into the immigration status of any person who reports that he is the victim of the crime or the parent or guardian of a minor victim, or is a cooperating witness in the criminal investigation or the parent or guardian of a minor witness. The bill does not prohibit a law-enforcement officer from inquiring into the immigration status of a victim or witness who has been arrested or charged with a criminal violation, or when such inquiry is required by federal law or is essential to the investigation or prosecution of the crime to which the person is a witness or of which the person is a victim.

In response to SB 462:

“Federal law prohibits SB 462 – SB 462 “restricts an officer’s ability by prohibiting law enforcement from asking about the immigration status of individuals, let alone ‘sending’ information about their immigration status to DHS (Department of Homeland Security). As such, SB 462 expressly violates federal law”.

This bill violates federal law – federal law prohibits state governments from ‘prohibiting’, or in any way ‘restricting’ any government entity or official from sending to, or receiving from DHS information regarding the citizenship or immigration status of any individual.

It is extremely important that you call all of our Hampton Roads State Senators who are committee members and tell them to vote “Yes” for HB737. You would be surprised at the number of legislators who say that they never heard from concerned citizens regarding pending legislation.

H.B. 737 E-Verify Program; requires state agencies and those newly hired to perform work in State.

E-Verify Program. Requires agencies of the Commonwealth and localities to enroll in the E-Verify Program by December 1, 2010, and to use the Program for each newly hired employee who is to perform work within the Commonwealth.
